Agreement to these terms

These Terms of Service govern your use of vitruvian.agency and the information and services presented by The Vitruvian Agency, a brand operated by Real Leads LLC ("The Vitruvian Agency," "we," "us," or "our"). By using this website, you agree to these Terms.

Use of the website

You may use this website for lawful business purposes, to learn about our services and to contact us. You may not interfere with the site, attempt unauthorised access, introduce malicious code, scrape the site in a way that burdens its operation, or use the site in violation of applicable law.

Audits and enquiries

Any initial account review, audit, estimate or recommendation is based on information you provide and data available to us at the time. It is supplied for evaluation and discussion. It does not create a client relationship, constitute financial or legal advice, or guarantee a particular result.

Client services

If you engage us as a client, the scope, fees, advertising budget, deliverables, responsibilities, term and termination rights will be set out in a separate written service agreement. If that agreement conflicts with these website Terms, the service agreement controls for the paid engagement.

Prices shown on the website are starting prices unless expressly stated otherwise. Advertising spend, taxes, third-party software, media production and work outside the agreed scope are separate.

Advertising platforms and client accounts

Advertising and analytics services are supplied by third parties such as Google, Meta, Shopify and CRM providers. Their availability, policies, review decisions, tracking methods and performance may change without our control. You are responsible for complying with the terms that apply to your accounts, products, claims and customer data.

Unless a written service agreement says otherwise, campaigns and tracking are built in accounts controlled by the client. Each party retains ownership of the materials and intellectual property it owned before the engagement.

Results and case studies

Advertising results depend on factors outside our control, including market demand, competition, pricing, margins, website experience, sales follow-up, inventory and platform changes. We do not guarantee a particular number of leads, customers, revenue or return on investment unless a signed service agreement expressly states a specific commitment.

Case studies and performance figures describe historical results for particular clients and periods. They are provided as examples and are not promises of future performance.

Intellectual property

The website’s text, visual design, graphics, logos, photographs and code are owned by or licensed to Real Leads LLC and are protected by applicable intellectual-property laws. You may view and print reasonable portions for your own internal, non-commercial use. You may not reproduce, publish, sell or create derivative commercial materials from the site without prior written permission.

SMS terms and conditions

If The Vitruvian Agency offers an SMS program, messages will be sent only to people who have opted in. By opting in, you agree to these SMS terms and our Privacy Policy.

• Program description. Messages may include replies to your enquiry, verification codes, appointment confirmations and reminders, requested audit-delivery notices, and conversational updates about a service you asked us to provide.
• Opt-in. You may opt in through a separate, optional and unchecked checkbox on an applicable form, by expressly asking a representative to text you during a call, or by making a written request. Consent is not a condition of purchase.
• Frequency and rates. Message frequency varies. Message and data rates may apply.
• Opt out. Reply STOP to any message to cancel. We may send one final confirmation, after which no further messages will be sent unless you opt in again.
• Help. Reply HELP for assistance or email anastasios@thevitruvianagency.com.
• Delivery. Mobile carriers are not liable for delayed or undelivered messages.
• Privacy. Mobile information and SMS opt-in data will not be shared with third parties or affiliates for their marketing or promotional purposes. Messaging providers may process it only as necessary to deliver the program.

Communications

When you contact us, you consent to receiving replies about your enquiry or service. If you separately opt in to marketing emails, you can unsubscribe at any time using the link in the message or by emailing us.

Website disclaimer

The website is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement and uninterrupted availability. We do not warrant that every statement will remain current or that the site will always be error-free.

Limitation of liability

To the fullest extent permitted by law, Real Leads LLC and its officers, contractors and affiliates will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from use of this website. Liability relating to paid client services is governed by the applicable service agreement. Where no separate agreement applies, our total liability for a claim relating to this website will not exceed USD 100.

The website may link to external websites, platforms or services. We do not control and are not responsible for their availability, content, security or privacy practices. A link does not imply endorsement.

Governing law

These Terms are governed by the laws of the State of Delaware and applicable United States federal law, without regard to conflict-of-laws rules. Subject to any binding dispute-resolution terms in a separate service agreement, disputes relating to these website Terms will be brought in the state or federal courts located in Delaware.

Changes to these terms

We may update these Terms from time to time. The effective date at the top of the page identifies the current version. Continued use of the website after an update means you accept the revised Terms.
